It’s illegal to be intoxicated in public. The offense is called Public Intoxication. It is harder for a police officer to prove you are in fact drinking alcohol if your beverage choice is concealed.
That’s what they come in at the liquor store, just so you can be a little discrete. If they are drinking from the alcohol, the person may also be trying to hide the fact that its alcohol to avoid getting a ticket for an open container.

Where I live, it’s a law that all liquor and wine must be in a bag before it leaves the place of purchase.
Watch that episode of The Wire where they invent “Hampsterdam”–I think it’s season 3. They say that they put the 40s or liquor in bags so that the police can “look the other way” and not waste time arresting an old man for drinking on his front steps, and instead stop robbers, drug dealers and violent criminals.

The actual reason is because paper bags from the liquor store, the super duty reinforced ones are less likely to break open and spill your liquor. They want strong bags to carry out so bottles don’t fall and break. They are cheap and effective.

because your not allowed to drink in public so if you put the bad over it people can’t see it. most places also give it to you in that brown bag too.
